The Calhoun School District sued its Calhoun Education Association, arguing that the union was bargaining in bad faith because the union did not accept the recent decision by the Michigan Legislature that certain subjects could not be included in a collective bargaining agreement with public teachers. (Issues like for example, requiring the school district to withhold union dues, along with charitable contributions, for example.) While the law allowed local districts and teachers unions to "discuss" the prohibited subjects, the Court ruled that once the District announced "clear statements that it would not include such language in the successor CBA," the Court held that the union was acting in bad faith by attempting to continue the discussion.
