Lisa Tuzas sued Cracker Barrel after she was discharged from her employment as a waitress. Tuzas had complained of sexual harassment to management, before she became involved in a verbal, profanity-laced altercation with a co-worker. Both employees were terminated, and Tuzas argued that her termination was improper retaliation for her earlier complaint. She also argued racial discrimination, alleging that African-American employees were not terminated for similar episodes in the past. The Court held that her participation in the inappropriate altercation was indeed "conduct unbecoming to the company" and adequate grounds for dismissal.
